1. Acceptance of Terms

Welcome to My Cup Of Tea School Lunch Delivery Service. By accessing or using our lunch pre-ordering service at lunch.mycupofteasf.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Service Description

My Cup Of Tea provides a school lunch pre-ordering and delivery service for students. Our Service allows parents and guardians to:

  • Browse weekly lunch menus
  • Pre-order lunches for their children
  • Manage dietary preferences and allergies
  • Make secure online payments
  • Track order history

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and a parent or legal guardian of a student to use our Service. By creating an account, you represent and warrant that you meet these requirements.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account information up to date
  • Immediately notify us of any unauthorized account access
  • Not share your account with others

4. Ordering and Payment

4.1 Order Deadlines

Orders must be placed by Sunday 9:00 PM for the following week's lunches. Orders placed after the deadline will not be accepted for the upcoming week.

4.2 Pricing

All prices are displayed in US dollars and include applicable sales tax. Prices are subject to change without notice. The price charged will be the price displayed at the time of order confirmation.

4.3 Payment

Payment is processed securely through Stripe at the time of order. We accept major credit and debit cards. By providing payment information, you authorize us to charge your payment method for all orders placed.

5. Cancellations and Refunds

5.1 Order Cancellations

Orders may be cancelled or modified before the Sunday 9:00 PM deadline at no charge. After the deadline, orders cannot be cancelled as food preparation has begun.

5.2 Refund Policy

Refunds will be issued in the following cases:

  • Service cancellation due to school closure
  • Inability to fulfill order due to our error
  • Food quality issues reported within 24 hours
  • Student absence (with advance notice before order deadline)

Refunds are processed within 5-10 business days to the original payment method.

6. Dietary Information and Allergies

While we make every effort to accommodate dietary restrictions and allergies, we cannot guarantee a completely allergen-free environment. You are responsible for:

  • Providing accurate allergy and dietary restriction information
  • Reviewing menu items before ordering
  • Understanding the risk of cross-contamination
  • Making appropriate decisions based on your child's needs

Important: If your child has severe allergies, please consult with your healthcare provider before using our Service.

7. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Submit false or misleading information
  • Abuse or harass our staff or other users
  • Use automated systems to access the Service

8. Intellectual Property

All content on our Service, including text, graphics, logos, images, and software, is the property of My Cup Of Tea or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reproduce any content without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, My Cup Of Tea shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from service interruptions or errors
  • Issues arising from third-party services (Stripe, Google, etc.)

Our total liability for any claim shall not exceed the amount you paid for the Service in the past 12 months.

10. Service Availability

We strive to provide uninterrupted service but cannot guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any service interruptions or discontinuations.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review the Privacy Policy carefully.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on our website and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

We may suspend or terminate your account at our sole discretion if you violate these Terms or engage in fraudulent or harmful activities. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.

16. Severability
